Our web service is designed to connect job-share seekers to one another. We consider it a friendly place, but provide rules to help keep it so.
By using Job Sharing Ltd (trading as “Job Sharing”) you agree to the following terms and conditions.
This document (together with the documents referred to within it) tells you the terms of use on which you may make use of our website jobsharing.co.nz (“our site”), whether as a guest or a registered user. Use of our site includes accessing, browsing, or registering to use our site. Please read these terms and conditions carefully before you begin using our site, as these will apply to your use of our site. We recommend that you print a copy of this document for future reference. By using our site, you confirm that you have the right, authority and capacity to agree to these terms of use and you accept these terms of use and agree to comply with them. If you do not agree to these terms of use, you must not use our site.
1. Information about us
Job Sharing is a web service (www.jobsharing.co.nz and www.jobshare.co.nz) provided by the New Zealand registered company Job Sharing Ltd (“We”) . We are registered in New Zealand as a limited company.
Our Privacy Policy sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. ∙
2. Acceptance of latest terms and conditions
We may revise these terms and conditions at any time by amending this page. Please check this page from time to time to take notice of any changes we make, as they are binding on you. You are responsible for ensuring you are familiar with the latest terms and conditions. The last update was on 20 April 2015.
We reserve the right to ban and remove any account for any reason.
3. Changes to our Site
We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.
4. Accessing our Site
We do not guarantee that our site, or any content on it, will always be available or uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
5. Membership
You must be a minimum of sixteen years of age and legally able to work in New Zealand to become a member and use our site. You shall not become a member until you register and receive email confirmation from us. You may not join Job Sharing if you already have an active membership, if you have ever been convicted of a criminal offence or have previously been banned from using the site. You must have a working email address for external contact listed in your Job Sharing account; a nonworking email may result in your account being removed. You must not attempt to log in to another member's account (even if you have permission from that member), create an account with a clear intention of impersonating another person, damage or harm the Job Sharing site or services, attempt to bypass any filters or protection, or access the website and chat rooms via any method other than that provided. We reserve the right in our sole discretion to refuse any application to become a member or to retract any membership or use of the site at any stage.
6. Your account and password
If you choose or you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@jobsharing.co.nz
7. Your profile
Job Sharing provides members with the ability to share personal information about themselves in a profile. This facility is exclusively for describing the member and any other use will result in the account being removed. We reserve the right to reclassify or remove photos without entering into further discussion with members.
8. Using our internal email
Job Sharing’s internal email system provides an avenue for members to easily communicate in a one-to-one fashion. You may not use the email system for any form of bulk email other than introducing yourself. Examples of impermissible bulk emails include promoting websites, alternative groups, events, meetings, opinions of other members or use of the service as a list server. Messages discussing competing connection services may be discarded.
9. You are legally responsible for materials you publish
You are responsible for all information you publish on Job Sharing, including but not restricted to images, your profile and messages. Job Sharing does not directly monitor or control all use of the site by its members. Accordingly you agree to accept sole responsibility for the legality of your actions under New Zealand law. You should be aware of relevant laws such as censorship and copyright.
10. Limitations on what you can publish
You are prohibited from posting or transmitting any unlawful, defamatory, threatening, obscene, libelous, incorrect or otherwise offensive material. Personal prosecution may result from breach of these requirements.
11. Our involvement with member to member communications
Job Sharing is not directly involved in member-to-member communications and activities. In the event you have a conflict with another member, to the extent permitted by law you hereby release Job Sharing, its agents and employees from any claims, demands and damages of every kind arising out of such conflict.
12. User information and identification
Proper authentication of users on the Internet is difficult. Job Sharing cannot and does not confirm that any member is who they claim to be. You should be careful in dealing with members.
13. Other obligations to Job Sharing
You must provide our staff with your real name and contact details if asked and obey any site operational instructions given, or alternatively remove yourself from our site.
Job Sharing is a contact service. Promotion of anything via unsolicited messages is not allowed.
You may not contact members that have previously ignored you, or if your intentions are clearly unsolicited and intend to be abusive or annoying. Stalking members and engaging in physically or verbally abusive threats may result in instant removal.
You may not publish member names, phone numbers, addresses, web addresses, email addresses or other identification in any part of your profile or in your first correspondence with other members. This is to prevent accidental publishing of your details, joking and other abuse taking place.
14. Site abuse, banning, suspension, restriction and removal
Job Sharing is committed to providing a safe and enjoyable experience.
We reserve the right to decline to register or to suspend, restrict or terminate your membership without entering into further discussions with you at our sole discretion if:

a serious complaint or multiple complaints are received about you from other members;

you fail to follow instructions provided by Job Sharing staff;

you abuse, harass or otherwise undermine Job Sharing staff;

you breach the Job Sharing Terms and Conditions or Privacy Policies,

you impersonate another person; or
-
Job Sharing deems your behaviour or use to be unacceptable or not in the best interests of Job Sharing or its members.
Members sharing a computer share responsibility for any problems originating from that computer. In the event of abuse, the computer or all memberships used on a computer may be removed and banned from Job Sharing. Banned members that continue to try and use our services are considered to be trespassing and may be prosecuted and agree to a NZD$5,000+GST cleanup fee. Such use is unauthorised use of our computer systems.
In the case of abuse or suspected abuse of our systems, members or the law, we reserve the right to pass any information stored on our systems to relevant authorities to help prevent the abuse. We will also provide assistance to help identify a member for members who are proceeding with, in our view, legitimate legal action. The protection of our members is one of our most important goals.
In the case of a paid member being banned or removed from Job Sharing, any paid services will not be refunded.
Members profiles will be removed if the Member has not logged into the site for six months or more. This is to ensure that the only users on the site are actively looking for partners to job share.
15. Refund and cancellation policy
Job Sharing is an Pay-What-You-Want based service, we do not provide refunds of any kind (subject to the NZ Consumer Guarantees Act).
Duplicate or overpayments may be charged a processing fee if refunds are required.
Memberships are not transferable to other accounts.
16. Unauthorised promotional activity
Job Sharing is a commercial activity and earns revenue from members paying via Pay-What-You-Want (an honesty box of sorts). We may also charge other commercial companies for services.
ANY commercial activity on Job Sharing, including but not limited to messageboards and private messages is prohibited without the express approval of our management. You agree to pay a penalty fee of NZD$1,000+GST for any unapproved commercial activity.
Commercial activity may not always involve money or pecuniary services. Examples of prohibited promotion include (but are not limited to) the promotion of charities, competitions, recruitment, personal services such as (but not limited to) massage or photography, multi-level marketing, fundraisers, events and political parties or candidates. This also includes the abuse or promotion of groups, websites, products or services.
17. Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged. You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
18. Reliance on information
The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. We recommend obtaining professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.
19. Liability
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by New Zealand law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied. Without limiting that we expressly point out to you that we assume no responsibility for the accuracy of information you or others post to the site or exchange with each other on or through or as a result of the site. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with: the use of, or inability to use, our site; or use of or reliance on any content displayed on our site. If you are a business user, please note that in particular, we will not be liable for: loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
20. Uploading content to our site
Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty. Any content you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site. We have the right to remove any posting you make on our site. The views expressed by other users on our site do not represent our views or values.
21. Your indemnity to us
The purpose of our site is to facilitate the connection of individuals who wish to share jobs and of employers who are looking for employees to job share. The site is limited to facilitating such connections (on the limited basis set out in this agreement). It is entirely your responsibility if you decide to contact potential job share partners or potential employers, and thereafter to negotiate terms of any job share. It is entirely your responsibility to ensure that your details are accurate, to check the accuracy of others and to make such connections as you wish and to make job share arrangements. Further you agree to indemnify us and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable legal fees and costs) related to all third party claims, charges and investigations, caused by (1) your failure to comply with these Terms and Conditions, including, without limitation, your submission of content that violates third party rights or applicable laws, (2) any content you submit to the site, and (3) any activity in which you engage on or through or as a consequence of the site.
22. Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site in any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. If you wish to make any use of content on our site in a manner other than that set out above, please contact us at hello@jobsharing.co.nz.

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.
24. Governing law
By using the jobsharing.co.nz website you agree that any contract in relation to the site and these terms is governed by the law of New Zealand, and as the material part of this agreement is formed with the Job Sharing services located in Auckland, that in the event of legal action, such legal matters and proceedings will be issued though the District Court in Auckland or in the event that the District Court in Auckland does not have jurisdiction, through the High Court in Wellington.
25. Disclaimer
Your use of Job Sharing is at your sole risk. Job Sharing expressly disclaims all warranties, express or implied, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, and non-infringement.
Job Sharing makes no warranty that:
- the services provided will be uninterrupted, timely, secure, or error free;
- the information provided on the site is error-free or reliable;
- the quality of the products or services obtained through Job Sharing will meet your requirements;
- the jobsharing.co.nz website will operate as intended in any software other than the listed compatible browsers.
No advice or information that is obtained by you from Job Sharing or otherwise shall create any warranty not expressly stated in the Terms and Conditions.
26. Compatibility
While jobsharing.co.nz has been tested on the browsers listed below, the site may function and we may be able to offer assistance with alternative browsers, however this is not guaranteed.

* Job Sharing will endeavour to ensure compatibility within three months of the relevant product's general new release.
